Special confiscation is “know-how” of Ukrainian legislation, which was actively discussed by Ukrainian society a little over two years ago, and most jurists categorically opposed such a bill. As a result of discussions, discussions and round tables, the bill was adopted and in Ukraine it became possible to “select” property without a verdict, so also from third parties …
Time passed, and today you can try to sum up the first results and talk about how this mechanism is working? Do they violate, in practice, the use of special confiscation of the right of third parties? How to protect their rights, third parties who are trying to select this or that property? How much did the state manage to return the funds? And most importantly, is the state ready to compensate for losses, in cases of improper confiscation?
